Omma Trucking provides frac sand transportation services, including but not limited to:

• Driver management and dispatch systems
• GPS tracking and navigation tools
• Pre-trip inspection applications
• Load management and scheduling
• Communication platforms for drivers and dispatch

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Driver Requirements

Drivers using our platform must:

• Possess a valid Commercial Driver's License (CDL)
• Meet all DOT and FMCSA requirements
• Maintain required insurance coverage
• Complete all required safety training and certifications
• Comply with Hours of Service (HOS) regulations
• Complete accurate pre-trip and post-trip inspections
• Operate vehicles safely and in accordance with all applicable laws

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Falsify or misrepresent information
• Interfere with or disrupt the Services
• Attempt to gain unauthorized access to any systems
• Share your account credentials with others
• Use automated systems to access the Services without permission

6. GPS Tracking and Location Data

By using our Services, you consent to GPS tracking during active operations. Location data is collected for dispatch coordination, safety monitoring, and operational efficiency. This data is handled in accordance with our Privacy Policy.

7. Intellectual Property

All content, features, and functionality of our Services are owned by Omma Trucking and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Omma Trucking shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amounts paid by you, if any, for using the Services during the twelve months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless Omma Trucking, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Midland County, Texas.
